General Terms and Conditions of Sale (CGV)
Effective date: 1 March 2025
1. Seller Information
The website etevert.com and the “etevert” online shop are operated by ETEVERT LTD, also identified in certain business records as ETZEN LTD, company number 17461048 and registration reference/SIRET supplied as LTD 17461048. The company is represented by Dayne Smith and has its registered address at 590 Rochester Way, London SE9 1RL, United Kingdom.
Customers may contact the Seller by email at [email protected] or by telephone at +44 59 48 74 15 22.
These General Terms and Conditions of Sale apply to all purchases made through etevert.com by consumers. By placing an order, the Customer confirms that they have read and accepted these terms before payment.
2. Products
The essential characteristics, available options and price of each product are shown on the relevant product page. Product photographs and illustrations are provided for information and may show minor differences in colour or appearance caused by screens, lighting or manufacturing variations. Such differences do not affect the Customer’s statutory rights where a product does not conform to its description.
Products are offered subject to availability. If a product becomes unavailable after an order is placed, the Seller will notify the Customer and refund any amount paid for the unavailable product using the original payment method.
3. Prices
Prices are displayed in the currency indicated on the website and include applicable sales taxes where the website expressly states that taxes are included. Delivery charges, customs duties, import taxes and any other applicable charges are displayed before payment where they can be calculated in advance.
For deliveries outside the United Kingdom, the Customer may be responsible for import duties, local taxes or customs clearance charges unless the checkout expressly states that these charges are included. The Customer is responsible for complying with the import rules of the destination country.
The Seller may change prices at any time, but products are charged at the price displayed and accepted when the order is submitted. If an obvious pricing or technical error occurs, the Seller may cancel the affected order before dispatch and issue a full refund.
4. Orders
To place an order, the Customer selects the desired products, reviews the cart, provides accurate billing and delivery information, selects an available delivery and payment method, and confirms the order after accepting these terms.
An automatic order confirmation acknowledges receipt of the order but does not necessarily constitute acceptance. The sales contract is formed when the Seller sends a dispatch confirmation or otherwise expressly confirms acceptance of the order. The Seller may refuse or cancel an order for legitimate reasons, including product unavailability, suspected fraud, payment refusal, incorrect customer information, resale activity or an obvious error. Any payment collected for a cancelled order will be refunded.
The Customer must verify all order information before payment and promptly contact [email protected] if an error is discovered. Changes cannot be guaranteed after an order enters preparation or has been dispatched.
5. Payment
Available payment methods are displayed securely at checkout and may include credit cards, debit cards and other payment methods supported by the website’s payment service providers. Card payments are processed by Stripe or another payment provider identified at checkout. The Seller does not receive or store the Customer’s complete card number.
Payment is due when the order is submitted unless a deferred payment method expressly provides otherwise. The Customer confirms that they are authorised to use the chosen payment method. Orders may be placed on hold or cancelled if payment is declined, incomplete, reversed or identified as potentially fraudulent.
The charge appearing on the Customer’s bank or card statement may be identified as ETEVERT, ETEVERT LTD or a similar shortened merchant descriptor. Payment information is processed in accordance with the security requirements of the relevant payment provider and card networks.
6. Delivery
Products are delivered to the address entered by the Customer during checkout. The Customer is responsible for providing a complete and accurate address and for ensuring that delivery can be accepted.
Unless a different estimate is displayed at checkout, orders are normally prepared within 1 to 3 business days. Estimated delivery is generally 3 to 7 business days within the United Kingdom, 5 to 12 business days within Europe and 7 to 20 business days for other international destinations. These periods are estimates and may be affected by weekends, public holidays, customs controls, carrier delays or circumstances beyond the Seller’s reasonable control.
If delivery is significantly delayed, the Customer should contact [email protected]. Where the law permits the Customer to set an additional reasonable delivery period and the Seller fails to deliver within that period, the Customer may cancel the affected order and receive a refund. This does not limit any right to cancel immediately where delivery by a specific date was essential and agreed in advance.
Risk of loss or damage passes to the Customer when the Customer, or a person designated by the Customer other than the carrier, takes physical possession of the products. If a parcel arrives visibly damaged, the Customer should photograph the packaging and products and contact the Seller as soon as reasonably possible.
7. Right of Withdrawal and Returns
Subject to the exceptions below, a consumer may withdraw from an online purchase without giving a reason within 14 days from the day on which the consumer, or a person designated by the consumer other than the carrier, receives the product. For an order delivered in several parcels, the period begins when the final parcel is received.
To exercise the right of withdrawal, the Customer must send a clear statement before the withdrawal period expires to [email protected] or by post to ETEVERT LTD, 590 Rochester Way, London SE9 1RL, United Kingdom. The statement should include the Customer’s name, order number, contact details, products concerned and the date of the request.
The Customer must return the products no later than 14 days after notifying the Seller of withdrawal. Products should be securely packaged and returned with their accessories and, where reasonably possible, their original packaging. The Customer is responsible for direct return shipping costs unless the product is defective, incorrect, damaged on arrival, or the Seller has agreed otherwise. The Customer should retain proof of postage.
Following a valid withdrawal, the Seller will refund the price paid and the cost of the least expensive standard delivery option offered for the order. Additional charges resulting from the Customer’s choice of an enhanced delivery method are not refundable. The refund will be made using the original payment method, without additional refund fees, no later than 14 days after the Seller is informed of the withdrawal. The Seller may withhold the refund until the returned products are received or the Customer supplies evidence of return, whichever occurs first.
The Customer may inspect products as they would in a physical shop but is responsible for any reduction in value caused by handling beyond what is necessary to establish their nature, characteristics and functioning.
The right of withdrawal does not apply where legally excluded, including to personalised or made-to-order products, products liable to deteriorate rapidly, sealed health or hygiene products unsealed after delivery, sealed audio, video or software products unsealed after delivery, and digital content supplied immediately after the Customer’s express consent and acknowledgement that the withdrawal right will be lost.
8. Refunds
Approved refunds are issued to the original payment method. After the Seller initiates a refund, the time required for it to appear in the Customer’s account is determined by the bank, card issuer or payment provider and is typically 5 to 10 business days.
If a refund appears to be delayed, the Customer should first check with their bank or payment provider and may then contact [email protected] with the relevant order number. Nothing in these terms restricts the Customer’s right to dispute an unauthorised or incorrect transaction through their payment provider.
9. Legal Guarantees
All products benefit from the statutory guarantees and consumer rights applicable in the Customer’s country of residence. For United Kingdom consumers, products must be of satisfactory quality, fit for their intended purpose, match their description and comply with the Consumer Rights Act 2015. Depending on the circumstances and applicable time limits, the Customer may be entitled to reject the product, request a repair or replacement, or receive a price reduction or refund.
Consumers residing in the European Union or another jurisdiction with mandatory conformity guarantees retain all rights provided by their local consumer law. These legal rights apply independently of any manufacturer’s warranty or optional commercial guarantee.
To make a guarantee claim, the Customer should contact [email protected] with the order number, a description of the issue and, where reasonably possible, photographs or other supporting information. Where the claim is valid, the Seller will bear reasonable return and redelivery costs.
Guarantees do not cover ordinary wear and tear, accidental damage, misuse, unauthorised modification, failure to follow care instructions or damage caused after delivery by improper storage or handling. These exclusions do not apply where prohibited by mandatory law.
10. Complaints and Customer Service
Questions, delivery issues, return requests and complaints may be submitted by email to [email protected], by telephone at +44 59 48 74 15 22, or by post to ETEVERT LTD, 590 Rochester Way, London SE9 1RL, United Kingdom.
The Customer should include their name, order number, contact details and a clear description of the issue. The Seller aims to acknowledge complaints within 2 business days and to provide a substantive response within 14 days. More complex matters may require additional investigation, in which case the Customer will be informed.
The Customer may also use any court, mediation or alternative dispute resolution procedure available under the mandatory law applicable to them. The Customer’s statutory right to seek a judicial remedy is not affected.
11. Liability
The Seller is responsible for losses that are a foreseeable consequence of its breach of these terms or failure to use reasonable care and skill. The Seller is not responsible for indirect or unforeseeable losses, business losses incurred by a consumer, or delays caused by events beyond its reasonable control.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, breach of mandatory product safety obligations, or any other liability that cannot legally be excluded or limited.
12. Personal Data
Personal data is used to process payments, fulfil orders, arrange delivery, prevent fraud, provide customer service and comply with legal obligations. Payment data may be shared with Stripe, banks, card networks and fraud-prevention providers, while delivery information may be shared with carriers and fulfilment partners. Further information is provided in the privacy policy available on etevert.com.
13. Force Majeure
The Seller will not be liable for delay or failure caused by circumstances beyond its reasonable control, including natural disasters, severe weather, war, civil unrest, epidemics, government action, customs disruption, transport interruption, labour disputes, utility failures or telecommunications outages. The Seller will take reasonable steps to minimise the impact and will refund undelivered orders where required by law.
14. Changes to These Terms
The Seller may update these terms to reflect legal, operational or commercial changes. The terms applicable to an order are those accepted by the Customer when the order is placed. Updated terms do not retroactively alter an existing order unless required by law or expressly agreed with the Customer.
15. Severability
If any provision of these terms is found to be unlawful, invalid or unenforceable, that provision will be applied to the maximum extent permitted or removed where necessary. The remaining provisions will continue in full force and effect.
16. Applicable Law and Jurisdiction
These terms and all sales made through etevert.com are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, subject to the mandatory consumer protection rules applicable in the Customer’s country of residence.
If the Customer is a consumer residing outside England and Wales, this choice of law does not deprive the Customer of protections that cannot be excluded under the law of their habitual residence. The Customer may bring proceedings before any court having jurisdiction under applicable consumer law.
